User agreement

1. General
   This agreement governs your use of the Bega Valley Regional Gallery's website, gallery.begavalley.nsw.gov.au. Your continued use of the site constitutes your binding acceptance of these terms and conditions, including any changes or modifications made by the Bega Valley Regional Gallery and/or the Bega Valley Shire Council. 
    
2. Use of Content
   You acknowledge that the site contains information, software, photographs, audio and video clips, graphics, links and other material (collectively, the "content") that are protected by copyright, trademark or other proprietary rights of the Bega Valley Regional Gallery and/or the Bega Valley Shire Council or third parties. All content on the site is copyrighted as a collective work of the Bega Valley Regional Gallery and/or the Bega Valley Shire Council pursuant to applicable copyright law. You agree to comply with any additional copyright notices, information, or restrictions contained in any content available on or accessed through the site. Users of the site may use the content only for their personal, noncommercial use.
   
   Unless otherwise stated, you are permitted (by way of a non-exclusive license) to make one copy of the whole or a part of any Commonwealth copyright works at this website for yourself or on behalf of another person, providing that you include in a prominent position the words 'reproduced with permission of the Bega Valley Regional Gallery and the Bega Valley Shire Council'.
   
   Permission is not granted to make a copy of online images on this site. Permission is not granted to make a copy of the whole or a part of the work where a charge is made for making and supplying that copy, unless the amount of the charge does not exceed the cost of making and supplying that copy. Greater rights may exist for some users. See Part VII of the Copyright Act 1968 here. You may link to these pages, but the content may not be altered.
    
3. No Endorsement
   The site may contain links to sites on the Internet which are owned and operated by third parties (the "External Sites"). You acknowledge that the Bega Valley Regional Gallery and/or Bega Valley Shire Council is not responsible for the availability of, or the content located on or through, any External Site.    You agree to indemnify, defend and hold the Bega Valley Regional Gallery and/or Bega Valley Shire Council and its affiliates, and their respective officers, directors etc. harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys' fees) incurred by any Bega Valley Regional Gallery and/or Bega Valley Shire Council Party in connection with any use or alleged use of the site under your password by any person, whether or not authorized by you.

   Neither the Bega Valley Regional Gallery and/or Bega Valley Shire Council nor any provider of content or their respective agents warrants that this site will be uninterrupted or error free. Neither the Bega Valley Regional Gallery and/or Bega Valley Shire Council nor any third party content provider warrants that any files available for downloading through the service will be free of viruses or similar contamination or destructive features. You expressly agree that the entire risk as to the quality and performance of the site is assumed solely by you. Neither the Bega Valley Regional Gallery and/or Bega Valley Shire Council, any third party content provider or their respective agents shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the site.
